Terms of Service

These Terms of Service ("Terms") govern your use of the Mobile Devotee website at mobiledevotee.com ("Site") and the MD Platform services ("Services") provided by Mobile Devotee ("we," "us," or "our"), based in Chicago, IL, United States.
By accessing the Site or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.
1. Services overview
Mobile Devotee provides white-label mobile application development, deployment, and ongoing operation services for service businesses ("Clients"). The specific scope of Services for each Client is governed by a separate client agreement entered into between Mobile Devotee and the Client.
These Terms apply to general use of the Site and do not supersede any executed client agreement. In the event of a conflict between these Terms and a client agreement, the client agreement governs.
2. Eligibility
You must be at least 18 years old and have the legal authority to enter into a binding agreement to use our Services as a Client. By using the Services, you represent that you meet these requirements.
3. Use of the website
You may use the Site for lawful purposes only. You agree not to:
- Attempt to gain unauthorized access to any part of the Site or its infrastructure
- Use automated means (bots, scrapers) to access the Site in a manner that places excessive load on our servers
- Transmit any malicious code, viruses, or harmful content
- Misrepresent your identity or affiliation with any person or entity
- Use the Site in any way that violates applicable local, national, or international law or regulation
4. Client services and commission
Clients who enter into a service agreement with Mobile Devotee agree to the following key terms (full details in the client agreement):
4.1 Commission
Mobile Devotee charges a commission of 10% on each completed, paid order processed through the Client's app. This commission is deducted automatically at the point of payment. Cancelled or refunded orders are not subject to commission.
4.2 No upfront fees
Mobile Devotee does not charge upfront development, setup, or monthly platform fees under the standard agreement. Additional premium services, if and when offered, will be subject to separate pricing agreed in writing.
4.3 Client responsibilities
Clients are responsible for: recruiting and managing their service providers; acquiring their own customers; providing accurate branding and service information; complying with applicable laws in their jurisdiction (including tax obligations); and handling customer support for their end users.
4.4 Mobile Devotee responsibilities
Mobile Devotee is responsible for: building, deploying, and maintaining the Client's branded app; hosting and infrastructure; App Store and Google Play submissions; payment processing integration; and ongoing app updates and monitoring.
4.5 Termination
Either party may terminate the client agreement with 30 days written notice. Upon termination, Mobile Devotee will provide the Client with an export of their customer data, order history, and brand assets within 14 days.
5. Intellectual property
All content on the Site, including text, graphics, logos, and code, is the property of Mobile Devotee or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
Client brand assets (logos, colors, names) remain the property of the Client. Mobile Devotee receives a limited license to use Client brand assets solely for the purpose of operating the Client's app.
6. Payment processing
Payments within Client apps are processed by Stripe, Inc. By using our Services, Clients and their end users are also subject to Stripe's Terms of Service. Mobile Devotee is not a payment processor and is not liable for payment processing errors, failures, or disputes handled by Stripe.
7. Disclaimer of warranties
The Site and Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Site or Services will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Limitation of liability
To the fullest extent permitted by applicable law, Mobile Devotee shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or goodwill, arising from your use of the Site or Services.
Our total liability to you for any claim arising from these Terms or the Services shall not exceed the total commissions paid by you to Mobile Devotee in the three months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Mobile Devotee and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: your use of the Site or Services; your violation of these Terms; or your violation of any third-party rights.
10. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in Cook County, Illinois, except that either party may seek injunctive relief in a court of competent jurisdiction.
11. Changes to these Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date. Continued use of the Site or Services after changes are posted constitutes your acceptance of the revised Terms.
